1. Introduction

Welcome to Facemaxx, operated by SERN (“Company”, “we”, “our”, or “us”). We respect your privacy and are committed to protecting your personal information.

This Privacy Policy explains how we collect, use, process, store, and protect information when you use the Facemaxx mobile application and related services (“Services”).

By using Facemaxx, you agree to the practices described in this Privacy Policy.

2. Information We Collect

We may collect the following information, depending on how you use the Services:

- Account Information: such as your email address, authentication provider information, and basic profile information if you sign in.
- Onboarding Information: such as age, gender, preferences, and answers you provide during onboarding to personalize your experience.
- Photos and Images: photos you upload or capture in the app for facial analysis and report generation.
- TrueDepth and Face Geometry Data: face geometry data generated at the time of capture on supported devices, such as facial mesh vertices, triangle indices, blend shape values, face transform data, camera transform data, camera intrinsics, 2D facial landmark points, and quality metadata.
- Facial Analysis Data: non-identifying analysis outputs derived from your photos, face geometry, and facial landmarks, such as scores, categories, summaries, measurements, and report results.
- Usage Data: information about how you interact with the app, including selected analysis modes, app events, device model, operating system, language, app version, and performance data.
- Purchase and Subscription Data: information necessary to verify purchases, subscriptions, or restore purchases, where applicable.
- Support Data: information you provide when contacting us for help.

Facemaxx provides multiple analysis features, including facial proportion analysis, aesthetic analysis, glow-up coaching, look archetype analysis, best photo selection, best angle guidance, dating profile scoring, and Instagram profile scoring.

3. TrueDepth API, Face Data, and Image Processing

Facemaxx may use Apple’s TrueDepth camera and ARKit face tracking features on supported devices when you choose to capture a face scan photo in the app. This is used only to provide the face analysis features requested by you.

When TrueDepth-supported face scanning is used, Facemaxx may collect and process the following face-related information:

- The face photo or image you capture or upload in the app.
- Face geometry data generated at the time of capture, such as facial mesh vertices, triangle indices, blend shape values, face transform data, camera transform data, camera intrinsics, 2D facial landmark points, and quality metadata.
- Non-identifying facial measurements and analysis outputs derived from the photo and face geometry, such as facial proportion metrics, symmetry-related measurements, scores, categories, summaries, and report results.
- Basic capture metadata, such as device model, operating system version, app version, image size, camera source, and tracking quality.

Facemaxx does not use TrueDepth API data, face geometry, photos, or facial analysis data to identify you, authenticate you, verify your identity, or recognize you across other apps, websites, or services.

- No Facial Recognition: We do not create or use facial recognition templates.
- No Biometric Identification: We do not use face data to identify who you are.
- No Face ID Access: We do not access, collect, or store Apple Face ID data.
- No Biometric Database: We do not build a biometric database.
- No Advertising Use: We do not use face data or photos for advertising targeting.
- No Sale of Face Data: We do not sell, rent, or share face data or photos for advertising or commercial resale.
- Purpose-Limited Processing: Photos, TrueDepth-derived face geometry, facial landmarks, facial measurements, and facial analysis data are used only to provide the analysis features you request and generate the requested reports.
- Temporary Server Processing: Photos and face data may be temporarily transmitted to and processed by our backend server only while generating the requested analysis. Server-side temporary image and face data are deleted after processing is completed.
- Third-Party AI Processing: For certain features, we may use trusted third-party AI service providers, such as Google Gemini or OpenAI, solely to generate the requested analysis results. These providers process the data only as needed to provide the requested analysis and are not permitted to use this data for advertising or to identify you.
- Secure Transmission: When photos or face data are transmitted for processing, they are sent using encrypted connections such as TLS.

4. How We Use Your Information

We use the information we collect to:

- Provide, operate, and improve Facemaxx
- Generate facial analysis reports and personalized recommendations
- Personalize onboarding, analysis, and app experience
- Save your non-biometric analysis results and app progress
- Provide account, login, and subscription features
- Improve app performance, reliability, and user experience
- Detect, prevent, and troubleshoot technical issues
- Respond to support requests
- Comply with legal obligations

5. Analysis Results

Facemaxx may store non-biometric analysis results associated with your account or device, including overall scores, selected mode, report summaries, result categories, timestamps, and related metadata.

These stored analysis results do not include your original face photos, TrueDepth mesh data, or facial recognition templates.

We may use de-identified and aggregated analysis data to improve the Services, generate benchmarks, understand app performance, and improve analysis quality. Aggregated data does not identify individual users.

6. Image, Face Data, and Analysis Result Storage and Retention

Facemaxx is designed to minimize retention of images and face data.

User face photos are not permanently stored on our servers. Photos and TrueDepth-derived face data may be temporarily processed by our backend server and trusted service providers only to generate the analysis requested by you. After processing is completed, server-side temporary image data and TrueDepth-derived face data are deleted.

User images are kept only in the app’s local cache on the user’s device for displaying selected photos, recent analysis views, and the in-app experience. You may remove locally cached images by deleting photos from the app, signing out, deleting your account, or uninstalling the app.

Facemaxx may retain non-biometric analysis outputs, such as scores, report summaries, categories, timestamps, and progress history, so you can view reports and track progress over time.

Face data and photos are not sold, rented, or used for advertising.

When you delete your account or request deletion, we delete or anonymize personal information associated with your account within a reasonable period, unless retention is required by law, fraud prevention, dispute resolution, security, or legitimate business records. Local cached photos and analysis results are also cleared from the device when you delete your account or sign out.

7. Aggregated Analytics and Benchmarks

We may create de-identified, aggregated statistics from app usage and analysis results, such as general score distributions, feature usage trends, and benchmark data.

These aggregated statistics do not include your photos, do not include TrueDepth face geometry, and do not identify you personally. They are used to improve Facemaxx and provide better user experiences.

We do not sell aggregated analytics data to advertisers.

8. Sharing of Information

We do not sell your personal information.

We may share limited information with:

- Service Providers: companies that help us operate the app, process data, host infrastructure, provide analytics, manage authentication, process payments, provide support, or provide AI analysis.
- Legal Authorities: when required by law, regulation, legal process, or to protect rights, safety, and security.
- Business Transfers: if Facemaxx or SERN is involved in a merger, acquisition, financing, restructuring, or sale of assets, user information may be transferred as part of that transaction.

Photos and TrueDepth-derived face data may be temporarily processed by service providers only as necessary to generate the analysis requested by you. These data are not shared for advertising, resale, biometric identification, or facial recognition.

Purchase providers, such as Apple and RevenueCat, are used for purchase validation and subscription management. They do not receive TrueDepth face geometry or face photos for facial analysis.

9. Third-Party Services

Facemaxx may use third-party services for authentication, cloud infrastructure, analytics, payments, support, and AI processing.

These third parties may process limited data necessary to provide their services. Their processing is governed by their own privacy policies and contractual obligations.

For certain analysis features, Facemaxx may use trusted third-party AI service providers, such as Google Gemini or OpenAI, solely to generate the requested analysis results. Face photos and related analysis inputs are processed only for the requested analysis and are not used by Facemaxx for advertising, resale, biometric identification, or facial recognition.

10. International Data Transfers

Facemaxx is operated from South Korea. Your information may be processed in South Korea and other countries where our service providers operate.

These countries may have data protection laws different from those in your location. Where required, we use appropriate safeguards to protect your information during international transfers.

11. Your Rights and Choices

Depending on your location, you may have rights to:

- Access the personal information we hold about you
- Correct inaccurate information
- Request deletion of your personal information
- Withdraw consent where processing is based on consent
- Object to or restrict certain processing
- Request a copy of your data
- Delete your account

12. Account Deletion

You may delete your account directly in the app or contact us at [email protected].

When you delete your account in the app, Facemaxx deletes account-associated analysis results, scan records, onboarding/profile information, usage records, and authentication account data from our backend systems, unless we are required to retain certain information for legal, security, fraud prevention, or dispute resolution purposes.

Local cached photos and analysis results are also cleared from the device when you delete your account or sign out.

13. Security

We use reasonable technical and organizational safeguards to protect your information, including encrypted transmission, access controls, and limited data retention.

However, no method of transmission or storage is completely secure. We cannot guarantee absolute security.

14. Marketing Communications

If you choose to receive promotional communications, we may use your contact information to send updates, offers, or product news.

You may opt out of marketing communications at any time by following the unsubscribe instructions or contacting us.

15. Children’s Privacy

Facemaxx is not intended for children under the age of 13, or the minimum age required in your jurisdiction.

We do not knowingly collect personal information from children where parental consent is required. If you believe that a child has provided us with personal information without appropriate consent, please contact us and we will take appropriate steps to delete such information.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will update the “Effective Date” at the top of this page.

Your continued use of Facemaxx after changes become effective means you accept the updated Privacy Policy.
